Hi All..
I am on H1 since Oct 07. I haven't left USA so far and so I haven't gone for stamping. However, I heard that I need to go to stamping before completion of 1yr after getting H1. Is this true? and to what cases does this rule apply?
Please help. I am confused.
Thanks,
rkdnc9.
You can stay as long as you have the 797 with you, but if you leave teh country u can come back only with stamping....

Hi
Tell them that you will report their activities to Dept of Labor.
email:info@dol.gov
Look for DOL local office. But before you do anything call an attorney speak to him.

Good thing is after 6 months of EAD ,change the jobs. So the new additional income added to your pot can be used to pay INS if there are any annual renewals till you get the GC.
INS will have atleast 200-300K 485 Applicaitons from Indians and equivalent from chinese, Mexico by July 31'st.
So INS will have a good beer party with Billions of Dollars and fixed royalty income from renewals from the potbellys of Indians, chinese, mexicans. This is a ballgame in no mans land.
Some one in INS did a good math to have good money. With these money, if the new bill et al is passed, can be used to build next gen systems.
Good Luck to everybody including me. I am also in the same race to get GC but i am far distant.

Can someone shed light on this topic?
I know Writ of mandamus cases are common for FBI name check delays.
What about AC 21?
When USCIS ignored AC 21 and denied I-485, did anyone file for Writ of Mandamus?
What are the costs involved?
How much time does it take to get a ruling from the court?

Hi,
I know this has been discussed a lot but I need advise or suggestions..
I am under Eb2 with priority date of Jan 2007 (labor and I140 approved) waiting for date to be current so that I can file I485 AOS....
My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..
Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..
Please advise..

You've been approved per your message below. So all it means in your case is that the USCIS has to let the Visa Center and/or Dept of State know that.

See the answers below, IN CAPS
I have couple of questions regarding timeperiod for which I can stay outside US while my I-485 is pending . I had to undergo a re-do surgery of my back in India and was adviced complete bed rest till it heals due to which I am outside US since Jan ending till date
1) Will it effect my GC application as some say its not good to stay more than 180 days outside US continously.
NO, IT SHOULD HAVE NO EFFECT. THE 180 DAY RULE IS MORE RELEVANT AFTER YOU BECOME A PERMANENT RESIDENT. IN THAT CASE IT IS BETTER NOR TO STAY OUTSIDE THE US FOR 180 DAYS.
2) I am on H1 status will it be a issue at POE to have gone for this long
IT MIGHT. I RECOMMEND CARRYING A LETTER FROM THE H-1B EMPLOYER CONFIRMING THAT YOUR JOB IS STILL OPEN FOR YOU.
3) What docs should I be carrying to awnser questions at POE.Is client letter mandatory or continued employment letter and I797 good
SEE ABOVE.
Kindly let me know your advice in this case

Hello,
I am trying to figure out if it is possible to sponsor (legal sponsorship support letter) my cousin back in India who is trying for higher studies in Canada (the letter to be shown to the Canada consulate). I am an Indian on H1B in US with Perm just filed.
I heard that being a resident alien myself (as opposed to permanent resident) I cannot sponsor him? Is that true?
If I can in fact sponsor him -- will that have any affect/complication whatsoever on my (i) Perm (ii) Tax application etc etc?
He is an 18 yr old Indian.
Thanks a lot for any advice!
Piyush
I am currently on a H1 & I sponsored my Brother's education in US last year and i think it is possible. It doesnt matter whether you are a Resident Alien or a Permanent Resident. All they want to see is whether there is an ability to pay the tution fees and support his living expenses. There shouldnt be any problem. Let me know if you need more info.

Just a heads up about the new filing requirements for I-129s and I-140s. See link. In a nutshell all I-129s go to Vermont Service Center and all I-140s go to the Nebraska Service Center.

The American Immigration Policy Center issued an excellent Fact Sheet about H2A farm orkers and the need for reform.
The Agricultural Job Opportunities, Benefits, and Security (AgJOBS) Act has long served as a blueprint for comprehensive immigration reform. AgJOBS, which combines an earned legalization program for farmworkers with a reform of the H-2A temporary foreign agricultural worker program demonstrates a successful model for compromise where workers and employers have come together to resolve their differences. The dysfunctional U.S. immigration system is currently standing in the way of addressing deeper structural problems that impact U.S. workers and U.S. competitiveness in a globalized market. As Congress proceeds, here are a few facts about the current challenges at the intersection of immigration policy and agriculture, and why addressing these issues is critical to the nations economy.
Here is an interesting fact :Most farmworkers are not authorized to work legally in the U.S.
According to the National Agricultural Workers Survey (NAWS), conducted biannually by the Department of Labor, the share of seasonal agricultural workers who reported that they were unauthorized has increased dramatically in the last two decades, rising from 7% in Fiscal Year (FY) 1989, to 16% in FY 1990-91, to 28% in FY 1992-93. In the most recently published NAWS survey from FY 2001-02, 53% of all seasonal agricultural workers admitted they were not authorized to work in the U.S. However, many experts suggest that the number may actually be closer to 75%.
