    H1B Visa Lawyer Blog Has Just Posted the Following:
    The United States Immigration and Customs Enforcement (ICE) recently updated their list of Student and Exchange Visitor Program (SEVP) approved schools (http://www.ice.gov/doclib/sevis/pdf/ApprovedSchools.pdf). The schools listed have all been certified to participate in the program.

    The program allows foreign students interested in obtaining an education in the United States to complete a visa petition, pay the required fee, and attend a U.S. College or University.

    Interested Foreign students: There is a process in obtaining a student visa, but it is not a difficult one. The student must first obtain Form I-20 from the U.S. College or University from which he/she intends to enroll, pay the required visa fee (Form I-901) and contact a local U.S. Consulate/Embassy to schedule an interview. The SEVP procedures differ among U.S. Consulates/Embassies; contact your U.S. Consulate/Embassy NOW to determine its particular procedure on applying for a visa before planning for the interview.

    Interested Schools: There is a separate process to obtain F & M Certification. Authorized school officials must obtain and complete Form I-17. An overview of the SEVP Certification process can be found on the ICE website . If approved, the school will be certified and allowed to issue Form I-20 to qualifying foreign students.

    USCIS website does not shows that my I-485 has been denied but instead it says that it has been sent to AAO office(appeal processing office).

    No I have not yet called attorney on extending EAD based on I-140 denial.

    Is your 485 also denied? Most of the times when ever 140 is denied then the underlying 485 also gets denied and if that is the case then you cannot apply or extend for EAD or AP until your appeal is pending with AAO. I may be wrong so consult an attorney.

    BTW....did you consult the attorney? If yes, what did they tell you?

    Hi,
    Any cases where the underlying I-140 was withdrawn after 180 days of the 485 being pending(changed jobs using AC21) got approved recently?

    I am current as per the July bulletin and would appreciate if some one else who is/was in a similar situation can provide their updates.

    I have a valid AP approved on Oct 13, 2007. The H1B visa stamped on my passport expired in Mar 2007. I have a valid one year H1B approval till Mar 2008. I do not have the original I797 approval notice but have a scanned copy of it. Now if I have to travel out of country in July and enter back on AP will there be any trouble at the POE with not having the original approval notice of last H1B.
    Any inputs will be appreciated. Thanks

    I came back from India last week, JFK was the Port of entry. All i showed them was the AP and my passport, they did not even ask for any other details. Infact all your details will be in their system which they will verify inside.
    I would not worry about it, but do carry your 485 filing reciept (i was never asked for one).

    We know we have our largest membership in CA. Well over a hundred members. Yet there are only about 10 active members. And yes, these 10 are extraordinarily dynamic, but we need more. In particular we need more members in SoCal.

    Those of you who have already signed up as volunteers -- please attend the weekly call this Thursday at 9pm PST. Once you are on the call, please speak up, take the initiative and work on something.

    Respond to the weekly emails.

    - Convince at least one more person to become a member
    - Convince at least one more person to contribute
    - Post our flyers in your neighborhood or workplace
    - Come up with other ways to get the word out
    - Join a lawmaker team
    - Start a lawmaker team and make an appointment

    IV cannot run without your help and fervour.

    Last week I received a copy of �Approved I-140� using Freedom of Information Act. I took almost 7 months to get requested information. Following are the steps to use FOIA:

    1. Write a cover letter (Sample attached)
    2. Complete Form G-639 (Sample form �Freedom of Information Act - G-639 - Form.pdf� attached)
    3. Write your I-140 Receipt # in �Column 4�.
    4. Important: Make sure you complete �Column 7� or you will be asked to send you application again.
    5. For �Column 8� you can sign it yourself under �Executed in US� (No need to use Notary)
    6. Send this form to:
    USCIS National Record Center
    FOIA Division
    P.O. Box 648010
    Lee Summit, MO 64064-5570

    I received copy of approved I-140 last week (Copy of 1st page is attached). You can check status of FOIA request at FOIA Request Status Check (http://www.uscis.gov/portal/site/uscis/menuitem.8d416137d08f80a2b1935610748191a0/?vgnextoid=f3a2ba87c7a29110VgnVCM1000004718190aRCR D&vgnextchannel=f3a2ba87c7a29110VgnVCM1000004718190a RCRD).

    I am on a L1 visa which has expired April 2006. I have got my petition extended till 2008. Can I transfer my L1 from Employer A to another Employer B. Can employer B transfer my current L1 petition to his company?

    I am on H1B and must travel to India to take care of a sick parent and would like to apply for 485 and then travel abroad....will this jeopordize my greeen card process?

    How much time did the attorney ask for on the I-129 and LCA? If either is just one year, then there's no basis for appeal. CIS did nothing wrong.

    I am July 2 filer and I called yesterday and they gave me this BAD news. They said "Other reasons". I can't think of what they could be. They said they are sending application back which I did not receive yet.
    Any one here unlucky as me unfortunately? Anyone have came across this situation? Your help will be greatly appericiated.

    I have I140 approved this year in March from NSC with EB2 category. My Employer sent I485 package with various checks I guess and our medical exam results.

    The Nebraska Service Center has approved the following I140
    Classification: E21
    Priority Date: 10/04/06

    My I-485 is filled at Nebraska Service Center. Does anyone has the address where to send AC21 job change letter ?
    I plan to file it myself.

    To where you sent your 485 package. I recommend to utilize services of Attorney - primarily because they attach their cover letter with their letterhead which could make some difference

    Hi ,
    I have applied 485 in July 2, 2007. Note that my PD Jan 2001 - EB3 (priority dated ported) And I140 is already approved. I have done FP in Oct 2007. Received EAD and AP way back.But I saw LUD on my 485 application on Dec 14, 2007.
    Does this mean any thing. Message content is not changed though.

    Suppose I am employed in H-1b with employer �X� for position �A�. Employer �X� filed my Labor Certification and I-140 for a future position �B� and got both approved. Position �A� and position �B� have at least 50% different job duties.

    I file my I-485 and it is pending for more than 180 days. I get a better offer from employer �Y�. Now, I want to transfer my H1-B to employer �Y� using AC21 portability rule. My job description with employer �Y� should be similar to position �A� or position �B�?

    I understand the 180 days rule after filing 485. what if the eb3(140 approved) based 485 has been pending for 180 days, and a newly approved eb2 140 has just been ported to the pending 485.

    Is there a rule that the 180 days started over again after porting, since it's a new 140, which implys the applicant intends to work for the 140 position for a period of time.

    What are the risks if the applicant changes the job right after eb2 140 gets approved, and changed the underlining 140 of the pending 485 from eb3 to the newly approved eb2.

    Any comments are really appriciated.
