Hi ,
I'm on H1B. Recently I joined new employer and the transfer is still in
pending status.
Among the documents required to sponsor for B2 visa, I'm supposed to
send copies of I-797 and I-94. I have old employers H1B approval notice
and I-94, but not of the new employers. I have the H1B receipt notice
related to the new employer.
Is it fine to sponsor for a B2 visa and for the visitors to attend the visa
interview in the US consulate with all the other essential documents
including new employers H1B receipt notice without the new employer H1B
approval notice.
Any of your valuable suggestions are welcome.

I think mom's in the forum can answer this better since i am sure many of them took short term disablity during delivery and subsequent months. My wife took it twice for the birth of our children and I dont think it is an issue.

Couple of questions folks:
1. Should H1 B Job and GC Job be related? I am going for an H1 B extension based on approved I 140.
2. Can we consider Software Quality engineer on H1B and Software engineer on GC related?
The NAICS occupational codes for
Software Quality Engineer is 541511
Software Engnieer is 541710
Can we consider them related for AC 21 purpose. I so not have the approved labor or I 140.
3. Currently am on H1 which is going to expire next month with my current employer and had my GC filed as a software engineer. I am planning to move over to the client where right now am working as a contractor. I am being offered a position as Software Quality engineer.

The only answer to your question is:"it depends". Who are your state's Senators and how interested/influential are they in immigration issues? Same question for whoever is the Congressperson for your district. I don't think any there is any harm in contacting both Senators as well as the Congressperson for your district.

I think you have to wait until your 3yr H1B is clear. If you find a new job before your current H1B expire, you may not have enough time left on your H1 to get the new GC labor and I-140 approved.

My I-140 will be approved shortly in premium processing and I'll be applying for 3yr H1 extension. There is a chance that I may get laid-off soon and I wanted to know if I can change the jobs while my H1 extension petition is pending with USICS. My current H1 will expire in June'07.

You maintain H-1B status as long as there is a relationship between u and ur company. This is usually showed by paystubs. If you do not, you can apply for H-1B transfer, but then the extension of stay will most likely not be granted, as the USCIS needs to see your paystubs. I would speak to an attorney about this.

That could be things like
NOID - Notice of intend to Deny.
RFE - Request for evidence.
For I-140 USCIS does not update the online status properly. For both of my EB3 and EB2 I-140s still the case status says they received the application and processing!
Wait for the document that they sent.

These days with tons and tons of I-485 applications received every morning, how is USCIS gonna decide which one to process first?
If it's strictly on "first received, first processed" base, then it may well be that one guy with 3/07 PD date may have his application processed earlier (thus earlier AP and EAD) than one with 5/06 PD date. Simply because the 3/07 PD guy sent out the package much earlier than the 5/06 PD one.
Do I understand correctly?
Is this fair, though?

I had a visa from Company A till Oct1 2008 and I 94 till that date.I changed to Company B and was given a new I 94 till June 2009.I made a trip to Canada and got a different I 94 again till Oct 1st 2008 based on the old stamped visa.I didnot get my passport restamped during the trip.
Questions
Which I 94 is valid?
Am I overstaying If I stay after Oct 1st?
I have an appointment in Halifax on 16th Oct,Will the Halifax consulate revalidate it?(I have changed companies here)

if monthly wages for an employees is 1000 per month then it should be 12000 per year) company need to prove the ability to pay $12000 per year.
but what if the LC was filed in mid year for example June 2005 and CIS RFE is asking to proof ability to pay (only One year) 2005
can it been showed as June - december = 7 month and onwards
$1000 x7= 7000
is it good approch or no
