Hello,
Could anyone please suggest me a few consulting companies who can sponsor H1B visa? I am trying to bring my friend who is in India working for an automotive OEM. He was in Michigan for a while and he went back to India and it�s been almost more than 7 years since he left but now he wants to come back to Michigan.
If anyone knows any consultants in Michigan would be perfect since I already have a job lined up (verbally) through my contacts but I am not successful finding an employer who can sponsor H1B for him.

I am considering switching my employer.
Currently I have I-140 and labor for GC approved in 2006.
Filed I-485 in July 2007.
My current H-1B expires on December 2009. (9 years on H-1B.... ya that long)
Based on my AC-21 portability after 180 days of I-140 approval, if I move to a new employer and file H-1B transfer, will I get default approval of only upto December 2009, or can I get 3-year extension based on my I-140 approval?
Appreciate your answers in advance.

You can get 3 years extension based on your approved I140. Please consult a lawyer before jumping into conclusions though.

You can get 3 years extension based on your approved I140. Please consult a lawyer before jumping into conclusions though.

Hi,
I am lost trying to find information on this.
Here's the situation for adding my wife to my I-485 application (we are from India). We DO have her 100% correct birth certificate we got issued last month.
However, since the issue date on it is April 2011, our lawyer insists that we need affidavits from her parents as well (perhaps to avoid RFEs). Further the lawyer insists that the Foreign Affairs Manual for India states that these be sworn in front of a first class magistrate of India.
When her parents went to the local court and request the first class magistrate, the court officer is demanding that we have a sealed copy of the requesting authority (USCIS) that clearly states that a first class magistrate's signature is required!
Questions:
(i) Is the affidavit supposed to be sworn in front of first class magistrate? Even if we have a corrected birth certificate?? Or can it be signed by an 'Executive Magistrate' or maybe even just notarized??
(ii) If yes, did someone else face a similar issue?
(iii) If yes, is there a USCIS document I could send to satisfy their demand?
I did try to find a USCIS document but all it states is that ... IF the birth certificate is unavailable ... then "sworn affidavits" need to accompany non-availability certificate from a competent local government authority.
Please advise :(
PS: FYI, they went to the Palghar court in Maharashtra, India.

In the current situation USCIS is going to receive around One or Two millions of AOS applications. Issuing EADs and APs are going to face huge delays. So If USCIS cannot keep the 90 day promise for EADs they should issue interim EADs Or Introdue Premium processing for EADs and APs.

Like many others, I was also unable to file my I-485 after the July 2 fiasco. My lawyer front-desked my application yesterday to ensure my eligibility for the class action. But he sent my application to the Texas Service Center instead of the Nebraska Service Center as was insructed in the form. Also, my employment letter was addressed to the Nebraska Service Center. His reasoning: my I-140 was approved by the Texas Service Center. Also, my name was spelt wrong on the FEDEX tracking system. Will USCIS reject it because of filing at the wrong service center...if so then will I lose my class status? Please shed some light.

Hello all:
Applied for 140 transfer TSC June 2007. Have not heard anything since, I mean absolutely nothing. Is this due to the backlog?? I am starting to get worried as I checked my status and all it says is, the received date and that when there is update they will let us know.
Did any of you apply 140 transfer in TSC around that time? Any news on those? Any case that it could've been lost?
Big question to the experts is, what do I do to make sure they are working on it and my application is in queue.

I am involved myself in a mess regardning the Green Card labor process
1) I had appplied for RIR labor in Apr 2004 and it was sitting in the Backlog elimination center (BEC)
2) In November 2006 I filed a conversion case and reapplied in PERM on my own while retaining priority date of april 2004.
3) Just last week I got a denial letter from DOL stating the reason
"The employer has not indicated on the application that applicants with any suitable combination training or experience are acceptable. the ETA form 9089 indicates the alien is currently employed by petioning employer and only qualifies for position identified in the application by virtue of the employers alternative experience requirement"
also the letter said
The job requirements did not exactly match the earlier case and hence priority date cannot be maintained
This denial also caused the automatic withdrawal of my earlier backlog case.
4) The priority date was very impt to me since I applied in EB3 and from India.
Is there anything I can do to maintain my priority date. I am also ready to forego the PERM application completely if only I could reinstate the earlier BEC labor case and just wait it out. I understand I commited a blunder by taking the risk of re filing in PERM while maintaining priority date...I feel i am losing almost 3 yrs of wait time and will be relegated to the back of the queue if I refile again

Yes I have known people done for H1 and H4 both. My friend who was fron MP usually get his H1 from Mumbai. But Last year he got his H1 stamped from Delhi just because he wants to go to Honeymoon there. Hope this helps.

We are posting the recent list of petitioners who received an approval in FY09 of Form I-129, requesting initial H-1B status for the beneficiary employee. Approximately 3,000 initial H-1B petitions are not accounted for on this list due to missing petitioner tax ID numbers.
While the full official final list of biggest H1B visa employers for FY2010 for the season has not been released, this preliminary list has been released for the Top employers this past US immigration year.
An H1B visa is a temporary working visa for professional positions, which allows foreign nationals to live and work in the U.S. for up to six years. This visa is an important tool for any employer to get the highly qualified technical expertise it needs to operate and grow its business.
If you compare the top 25 employers of US visas in 2009 to the past Top 100 H1B visa employers of FY2009, that many companies like InfoSys, Tata and Satyam have dropped substantially both in the number of US visas for foreigners applied for and their overall rank. In the cases of Tata and Satyam, they are not even on this top list anymore.
This further shows again both the fallacy of the arguments perpetuated by bigots in the US Congress and the US media about foreign companies (mainly Indian) taking the jobs of US citizens.
