Dear Sir/Madam,
I married to a US citizen and got conditional permanent residency which is subject to be removed after 2 years. I have been a student at a university, and while an application for permanent residency I had to show/combine my income (student teaching/research assistantship) in I-864 because my spouse's income was not sufficient to sponsor me. In form I-864 instructions it says, "Intending immigrant is your spouse, his/her income can be used to combine with your income if his/her income will continue from the same source after receiving lawful permanent residency." Now, my question is that I have an offer of admission from other school, and this new school will pay me student teaching/research assistantship, can I leave my current school and join the new one? If not, how long I have to wait in order to have right to change my school?
Secondly, can my spouse leave her job and sit idle? I ask this because my spouse sponsored me in I-864, and I wonder until when she is supposed to continue her current job!
Please advise me your best to help me with my doubts. I will be obliged!

Hi,
I am a july 21 filer and received I-485 notices on Sept 26. I am required to join my job on Oct 8 and i want to use the EAD for that.
My question is, if i see the status as "card ordered" before Oct 8, then can i call USCIS to get the EAD number before joining the job. OR does the employer need to be shown the EAD card before joining.
It looks like it is taking 1 week from notice date to see the status change to "Card Ordered" and another 7-10 days or more to get the card.

You would require copy of the approval notice of 140 from the old company.
In the new company, you would need to file a new labor via PERM. Once it is approved, you would need to file a new 140 and use the copy of the old approved 140 to port your priority date.

My passport was expiring so I applied for the new passport to indian embassy San fransisco. I got this new passport from indian embassy san fransisco. Now my company has applied for my H1B extension with the details of this new passport. We got a receipt number for the H1B extension but it looks like that it will take 2 more months to get the actual extension in hand.
Recently I found that my new passport has my mother's name speling mistake (one letter wrong). I am planning to call indian embassy to make this correct. As they made this mistake while creating this new passport ( my old passport and the application had the correct mother name )

Careful! B4 GC is issued, you will have to show proof that you are still with the sponsoring company or working in a similar job /similar pay with another company.
1) b4 you leave the job make sure your i-485 has been pending for over 180 days
AND
2) Your i-140 is APPROVED

If you file the extension before expiry of the current I-94, you will be OK. It can be approved even after the expiry. She will be considered to be legally present without gap, if extension is granted.

My wife is currently in the US on H4 Status and she is taking classes at a local university on a part time basis.
We are planning to go for our visa revalidation next month.
How should i answer DS 156 Question #33.Do you intend to study in the US? for my wife?
I think i should answer yes since she will continue taking classes after we come back to the US. Will this be an issue since she is on H4?

your wife should be fine and within status even you changed the job.
I asked this same question to my lawyer in 2006. we got that its valid.

3. Send all IV members in that area .. email templates about the rally that they need to forward all folks they know. If everyone gets 2 friends .. and those 2 get 2 more .. we have a large number.
Get folks from other immigration forums as well. We had chinese folks with us .. and I think they were from some other forum/group.
check will all local groups so that there can be a show of strength !!

I am planning to file H1 petition through a sponsor . I am having questions for h1 duration and initial h1 approval time, here is my details :
I am on L1 right now and my L1 stay in US is :
Apr'07 - Dec'07 - 9 months
Jan'08 - Mar'09 - Was in india
Mar'09 - till date - ~13 months.
Now my questions are :
1) If I apply for h1, how much time I can stay on h1 considering L1 stay as well ?
2) How much time initially h1 could be approved before doing h1 extension for another 3 years ?

This was expected. Tancredo was a single issue candidate and most people of this good country are sensible. They see him for what he is. Economic hardships combined with lots of false information can easily bias even the most well meaning citizen.
He did manage to bring illegal immigration topic to prominence and promoted general hatred towards immigrants. Personally I am happy he is out and I hope this country will be spared from any further "public service" from this abominable politician.

I am having my EAD and AP and I am not using my EAD.
EAD expires Sept 08
AP expires Oct 08
My question is
Can I renew AP only ?
If, I do not renew EAD will it be a problem in the future ?
Can I renew it after EAD has expired ?
Also, If I am renewing AP only, when does the 120 days rule come into picture.
Is it with the AP date or EAD date.
Your input will be appreciated.
