BusinessWeek featured an excellent story about O1 visas, often known as the Genius visas. While the spotlight is now on H1B visas or the debate on Immigration Reform, it is important to cover this important and often overlooked visa.
O1 visas are awarded to immigrants with extraordinary abilities in the arts, sciences, education, business, or athletics. The program, for what are officially called O-1 visas (http://www.h1b.biz/lawyer-attorney-1137182.html), began in 1990 as lawmakers sought to separate these applicants from the pool of those seeking H-1B visas, the visa program for skilled immigrants used by many technology companies. While H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) applicants must hold at least a bachelor's degree and possess some specialized skill, O-1 visas (http://www.h1b.biz/lawyer-attorney-1137182.html)are allotted to a more elite crowd: those who can prove to U.S. immigration officials that they are the very top in their fields.
According to the U.S. State Dept.�which makes the grants to successful applicants�9,014 O-1s were awarded in 2008, up 40% from 2004. Among current O-1 visa holders are Dallas Mavericks forward Dirk Nowitzki, Canadian author Jennifer Gould Keil, Israeli concert pianist Inon Barnatan, and members of the New York dance companies Merce Cunningham and Bill T. Jones/Arnie Zane.

I don't know anyone in Chicago. But I think it does not matter. You can hire an attorney from other city/state as long as he/she is competent. We live close to chicago, but our immigration attorney is in Michigan.
We had a great experience with this attorney. She is thorough, clear, always accessible and prompt. And she does not charge a fortune either like others. She does not even charge extra for phone calls, emails, etc.
The office is Law Offices of Ingrid Brey P.C. in Grosse Point Park, MI. Just google it and call the office. Have them email their services/charges, etc.

My current company's CEO is retiring and the other partners are forming a new company. The current company will continue as a corporation and in the new corporation the current CEO will have 10% share. The new co will start with the current client base, employees, equipment, web site and use the current company's name as a DBA.
I am on H1-B visa with the current company and in the process for Permanent Residency with my I-140 approved and awaiting for the Priority Date to become current .
If the current company terminated me and i got re-hired with the new co.. what would i need to do for my H1-B visa and the Green card process. Please advice ASAP.

I got my checks encashed to day and when I looked at the status of my I-485 application online it says

I have got this response from Congressional Liaison, when I asked them for Update on my case whether I have to wiat till Oct or not based on the recent update on visa bulletin.
They Sent me This Email:
Your I-485 received on 5/21/07 and the Southern Service Center(TSC) is working these types of applications filed 9/11/06. They received your biometrics from the ASC 6/13/07 and the case has been assigned to an Adjudicating Officer for review. But, by the processing times, you still has a little time to wait.
Couple of question: They received your biometrics from the ASC 6/13/07 : Is this mean my FBI and Name Check cleared : I did my FP on same day?

My case was approved by BEC on July 18. My attorney says that my 140 has to be filed by July 31 to be eligible to file under July visa bulletin [by 17th August]
Is his interpretation correct?
I can not do concurrent for a few more days, until my family returns from India.
If I go with 140 now, I am afraid the 140 receipt may not arrive in time for me to file for 485.

thanks a lot for your reply. It gives me great comfort knowing that I am not risking it all for an EB2 on which the attorney is only 50% hopeful

Hi - I am on 7th Year of my H1. My I-140 has been approved. My I-485 is pending for while plus my PD is not current as of Jan 09. In this case...
a) Am I eligible to apply for H1 extension (I don't want to use EAD)?

I have an approved I-140 from my previous employer. Is there anyway, I can expedite my labor certification, I-140 approval and I-485 through my new employer on the basis of the previous approvals? I have a PD of jan'04. I know I retain my PD due to the I-140 but I wanted to know if there is anyway to not wait for the time it takes to get approval on LC and I-140.

I am working on H1-b visa. My green card stage: Priority date July '06, EB3, India. I-140 approved, I-485 filed Sept'07. I don�t intend to use EAD for employment now.
I have a need to get my future spouse on H-4 visa. With EB3 India priority dates retrogressed, filing dependent I-485 for spouse is years away. (Unless rules change!)
Question 1: IF I loose my H1-b status (job loss) and find a new job using my EAD, my spouse on H-4 goes out of status. So what all options do I have to keep her in a valid status?
Question 2: Proactively, say my spouse (when on valid H-4 status) starts a Masters program (part-time) at a University, can she file for a H4 to F-1 change of status (COS) that very week or month I loose my job. Or are there any serious timing issues in this option?

I plan to probably file under the EB2 category soon- I know EB1 and EB2 can be filed separately, however can a EB2 regular and a EB2 with NIW application both be filed separately as well?

Does anyone know if there would be some kind of record about
when and how many times we have spoken to the IIO.
Like will a IIO be able to look at one's receipt# and say if they have spoken to an IIO earlier that day or whenever that is?

1) You need to call US Consulate/Embassy in London, UK for application pack(this will take approx 1 week) and appointment date. The availability of appointment date would be a big question mark.
2) After receiving application pack in post you need to get money order from bank for the application fees.
Note: US consulate in UK prefer candidate to apply from the home country. My case was diverted to Mumbai when I hv applied from London. I got my H1B visa from Mumbai.
