Hi-
My current EAD was issued in 2007 when I filed I-485 + I-140 concurrently. It has since expired. I did not apply for a renewal because I am still on my H1B.
I am applying for a renewal now and had a question regarding filling out form I-765
Q15. Current Immigration Status ( Vistor, Student, etc )
I am still on my H1B. So I think I should write H1B and not AOS. But I am not sure.
I filled (C)(9) for Q16 Eligibility Criteria, and since I live in Ohio I am sending it to USCIS Phoenix Lockbox Facility. My receipt notice is Aug 2007 and to be sure I am including the $380 fee.

Can the core group let us know what are they targeting right now? Are they targeting CIR next month? The lack of direction will really lead to less contribution. Without that,I will have a hard time convincing other friends about IV.

Hi Vinod,
As a practical matter, you probably want to file your wife's I-485 application as soon as possible after the first day of the month in which your PD becomes current. As you know from experience, PD's can and do retrogress dramatically with little or no notice.
If your wife is in H4 status on the date that your GC is approve, she will automatically fall out of status. She can remain out of status for up to 180 days without losing eligibility to file for AOS, but if the PD retrogresses before she files, she has to wait and hope that your PD becomes current before 180 days have passed.
If your wife changes status to E-3 she can still file her I-485 when your PD becomes current. But,
E-3 status, unlike H-1 status, requires non-immigrant intent. So, theoretically, if your wife changes to E-3 status and then files the I-485 within 60 days, an allegation of immigration fraud could be made and possibly result in denial of her I-485.

Not sure if I posted this on right forum....
I'm at 485/EAD stage. not on H1b anymore. I recently badly sprained and fractured my ankle/foot. Am considering taking a leave for maybe two weeks from work.
Question: does going on short term disability and getting benefits from the state have any adverse effect on the immigration process?

I will take this oppurtunity to thank everyone who showed the courage by joining us at Washington DC.
It was a great pleasure meeting all the people from the New England area. I finally got a chance to put a face to all the names with whom i have talked on conference calls. This was just an amazing experience and i am hoping we will get a chance to have more such experiences and we will keep on continuing our efforts till the time we get the system fixed.
Folks, the rally was a huge success. The situation room (15th, 16th, 17th) was an example of all the positive energy which was builing up for the rally.
The reception(17th) was a showcase of IV. The rally(18th) was the final bang.
But inspite of having so many people affected from the GREEN CARD delays from the New England area, we just had a few folks show up at the rally. This was really disappointing.
I am sure there must be a very good reason for that. But if you have any doubts, we will really like to talk to you and clarify your doubts.

Yes you have to fill out separate forms. I applied for my parents last october. One of them got it in 10 days and the other took more than a month. It is advisable to get the application in well ahead of your trip

Have a question on EAD/H1b. I am joining a new company using AC21 and EAD. Lets say after few months if INS denies my GC application then will I be able to transfer my h1b. Basically I got the info that I can re-capture my unused period of H1b out of 6 years. Is that true ?

Unfortunately, he did not get his renewal EAD in hand before the expiry of the current EAD, so the lawyer submitted a H-1B petition to use the unused portion (India vacations for him, but basically any time when you were outside the US) from his old H-1B so my friend could continue working. If I remember well, it was applied under Premium Processing, but I know for sure that it definitely came through. But so did his EAD card...on the day his current EAD expired.
Again, I want to reiterate that I don't know how the above scenario plays out if the GC is denied, so do check with a lawyer.

Hello everyone,
It is extremely unfortunate but I have lost my green card. I can�t seem to find it anywhere. I know that it has not been stolen, just lost! I need to apply for a replacement green card ASAP. I need to submit some initial documents along with my I-90 form for it. I have been trying to search on the internet regarding it but I can�t seem to find a clear answer.
Long story short, could somebody please tell me what initial documents are there to submit along with my I-90 form? I have a copy of my original green card, but is there anything else required? Am I required to submit my photos along with my form?
I would highly appreciate if someone could reply to my queries ASAP.

When my wife lost it, I sent the copy of the green card along with I-90. I also went to the local USCIS office to get the stamp of I-551 on her passport as well.
I believe they will schedule for fingerprinting and photo will be taken at that time. (eventually we did found her missing GC and cancelled the request and hence did not go through the entire process) :)

It is best to not do anything while on the B visa, and relinquish the B status, then either re-enter on a stronger intent visa (H1/H4 or L1) and then file 485 or file the 485 from outside the country.
Agree with what mihir is telling here. Just a minor correction - 485 can be filed only when one is present in the US.

You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.

Hi,
Currently working with Company A, where I have I-140 approved. The employer is willing to file I-485. Also have a better offer with Company B, and have H1B approved. Is it possible for me to take leave from company A (using my PTO) and joint company B, keeping both jobs on H1B status?
As my H1B is valid with 2 companies, and both are for full time positions. Is it okay for me to be actively employed with both companies at the same time for 2 or 3 months? Do I violate any H1B regulation, that may cause denial of I-485 at later stage?

For all the friends at IV who have already received their EAD's and/or renewed their EAD's i wanted to ask how long does it take for a person to receive their EAD after filling their 485 provided their date is current. Is filing for EAD an additional step to filling a 485 once the date is current?
2nd scenario: If i decide to change my job and my I-140 is approved with my current employer. The new job is the same level and category as my job description on my current I-140, in a new company. Can i port my PD with the new employer without any affect of I-140 withdrawl from my old employer or will the porting need to be executed prior to my old employer pulling the I-140 petition? I have some understanding about the situation but i wanted multiple opinions just to firm my understanding. Thanks in advance and may GOD help us all through the wait period to get our destinations.

Did you know that more than 1 million green cards were issued in 2009 and less than 60,000 went to actual high skilled immigrants??
